These Terms of Use ("Terms") govern your access to and use of the Rivia website, mobile experiences, and related services (collectively, the "Services") operated by Rivia ("we," "us," or "our").

By accessing or using our Services, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

• You must be at least 18 years of age, or the age of majority in your jurisdiction, to use our Services and place orders
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account
• You agree to provide accurate, current, and complete information during checkout and account registration
• We may suspend or terminate accounts that violate these Terms or present fraud or security risks

We make every effort to display our products, colors, materials, and pricing accurately. However, we do not warrant that product descriptions, images, or other content are error-free, complete, or current.

All prices are shown in U.S. dollars unless otherwise indicated and are subject to change without notice. Applicable taxes and shipping charges are calculated at checkout.

Product availability is not guaranteed. We reserve the right to limit quantities, discontinue items, or refuse orders at our discretion, including orders that appear fraudulent or resold in violation of these Terms.

Gift cards and promotional credits, when offered, are subject to separate terms disclosed at the time of purchase or issuance.

• Your order constitutes an offer to purchase. We may accept or decline your order for any reason, including product unavailability or suspected fraud
• Order confirmation emails acknowledge receipt of your order; acceptance occurs when we ship the item or charge your payment method, as applicable
• You authorize us and our payment processors to charge your selected payment method for the total order amount, including taxes and shipping
• We may cancel orders if payment cannot be verified, items are unavailable, or errors in pricing or product information are discovered

Shipping times, rates, and delivery terms are described in our Shipping Policy. Risk of loss passes to you upon delivery to the carrier, except where prohibited by applicable law.

Returns, exchanges, and refunds are governed by our Returns & Exchange policy and Sales and Refunds policy. By placing an order, you agree to those policies as incorporated into these Terms.

All content on our Services — including text, graphics, logos, product designs, photographs, video, software, and trade dress — is owned by Rivia or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent, except for personal, non-commercial use necessary to browse and purchase products.

The Rivia name, logo, and related marks may not be used in connection with any product or service that is not ours without written permission.

You agree not to misuse our Services. Prohibited conduct includes, without limitation:

• Attempting to gain unauthorized access to our systems, accounts, or customer data
• Using automated tools to scrape, harvest, or interfere with site functionality
• Submitting false orders, fraudulent chargebacks, or reselling products in violation of applicable law or our policies
• Uploading malware, spam, or content that is unlawful, defamatory, or infringes third-party rights
• Circumventing security measures or testing vulnerabilities without authorization

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, secure, or free of errors, or that defects will be corrected.

Some jurisdictions do not allow limitations on implied warranties, so some of the above exclusions may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, RIVIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RIVIA FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Nothing in these Terms limits liability where prohibited by law, including liability for death or personal injury caused by negligence or for fraudulent misrepresentation.

You agree to indemnify, defend, and hold harmless Rivia and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Services, or infringement of any third-party rights.

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.

Any dispute arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts, unless applicable law requires an alternative forum.

Where permitted, you agree that disputes will be brought on an individual basis and not as part of a class, consolidated, or representative action.

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Material changes may be communicated by email or a notice on our website where appropriate.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

• If any provision of these Terms is found unenforceable, the remaining provisions remain in full force
• Our failure to enforce any right or provision is not a waiver of that right or provision
• These Terms, together with our Privacy Policy and referenced policies, constitute the entire agreement between you and Rivia regarding the Services
• You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger or sale of assets
